We warmly welcome you to our Casa Kuiper. With the confirmation of a reservation, these Terms and Conditions become effective.
Definitions:
Owner: Raymond and Saskia Kuiper
Administrator: substitute in the absence of the owner
Guest: principal guest and fellow guests staying at the Casa Kuiper
Third party: any other legal entity that is not a guest, administrator or owner
General:
– These Terms and Conditions apply to all guests of Casa Kuiper, Avenida Suiza 15, Urb. Las Golandinas, Apartamento 52, 29650 Las Lagunas de Mijas, Malaga.
– Under Casa Kuiper is also understood Apartement Casa Kuiper
– Guests of Casa Kuiper must abide by these General Terms and Conditions/Household Regulations, in case of violation and inappropriate behavior, the owner or manager may deny and/or refuse access to Casa Kuiper De with immediate effect, without further notice and justification and without refund of the accommodation costs.
– The principal guest must be 25 years of age or older, responsible for his or her fellow guests and must have a permanent place of residence or abode.
– A copy of the General Terms and Conditions/House Rules will be provided upon request. Also available for inspection in the rooms of the Casa Kuiper and on the website www.casakuiper.com
Casa Cooper:
– Casa Kuiper is described on the website www.casakuiper.com
– This website is composed with the greatest care, however, there may be differences between the text and / or photos presented on the website and the actual situation at the Casa Kuiper at the time of the stay of the guests. No rights can be derived by the guests from such differences.
– No pets are allowed in the apartment and it is non-smoking. This way we ensure the most healthy and clean apartment.
– Check-in is between 2PM and 6PM. Check-out is until 10.00AM.
– If you wish to arrive later there will be additional charges. Please contact us.
– Casa Kuiper is an apartment and is rented as a whole, rooms are not rented separately.
– The apartment can accommodate up to 4 people.
– It is not allowed to stay with more persons than agreed upon.
– Parties, events or nuisances are not allowed.
– Cameras are present on the premises of the urbanization for your own safety and property.
Reservation and confirmation:
– Booking our apartment can be made by phone, email or our website www.casakuiper.com.
– Upon receipt of a reservation request, Casa Kuiper will send a confirmation email (if the apartment is available). At that time, the General Terms and Conditions will be in force
– If we do not have your contact details, it is not possible to provide a final confirmation.
– To register with the relevant Spanish authority, Casa Kuiper receives from the principal guest his/her first and last name, date of birth and passport number. We are obliged to pass this on.
– Casa Kuiper does not charge a reservation fee
– After payment of your reservation, it is final for both parties.
Payment:
– The prices of our apartment are described on our website: www.casakuiper.com
– Prices include use of towels, bed linen, water and electricity, air conditioning and final cleaning.
– The reservation is final upon receipt of the deposit. The deposit is 50% of the total amount.
– The deposit will be paid within 7 calendar days of receiving the confirmation, indicating the booking number.
– The remaining outstanding amount must be remitted 14 days prior to arrival.
– If the deposit is not received in time, the reservation request will be canceled. The guest will be notified of this by e-mail.
– For reservations with arrival within two weeks, the full amount must be paid immediately.
– Business guests always receive an invoice. Private guests may also request one.
– Payment should be made to our bank number: ES49 0081 0588 8600 0330 5936 in the name of S.J.B. Kuiper van Schaik, quoting the booking number.
Liability:
– Casa Kuiper is not liable for damage, theft or loss of guests’ property. In case of disputes, all (legal) costs will be borne by the guests.
– All risks related to staying at Casa Kuiper are the responsibility of the guests and the owners cannot be held liable for personal injuries resulting from staying at Casa Kuiper.
– This includes failures and breakdowns of power, water and technical facilities, unknown work and unforeseen noise in the area.
– Damages and missing property in and around Casa Kuiper must be reported by guests immediately and will be reimbursed to the owners.
– Any repair or replacement costs, for example loss of key, all resulting costs will be charged to guests.
– A stay on our urbanization is entirely at your own risk.
Cancellation / No-Show (without cancellation not coming) by the tenant:
– If the reservation is cancelled, the following conditions apply:
– If cancelled 3 weeks or earlier before arrival date; no cancellation fee.
– If cancelled 20 days or less before arrival date or in case of no-show; 80% cancellation fee.
– Only at the discretion of the owner or manager (for example in case of emergencies), the cancellation conditions may be deviated from.
– In order to be eligible for any refund, the cancellation must be communicated directly to the owner by e-mail.
– After consultation, the agreed amount will be transferred within two weeks.
– In case of early departure, no refund will be made.
Cancellation by landlord:
– Casa Kuiper can cancel the reservation agreement only in case of force majeure, natural disaster, extraordinary weather conditions, fire, death of the owners or family, hospitalization or unannounced sale.
– In any of these cases, the owner or manager will offer the guest an alternative as soon as possible.
– If no alternative is possible or the guest does not accept the alternative offered, a full refund will be made. Any other costs resulting from the cancellation will not be reimbursed by the owner.
– We recommend travel and/or cancellation insurance.
These cancellation terms apply only to direct booking and not to booking sites such as Booking.com or Airbnb. These organizations have their own terms and conditions.
Privacy:
– Personal data provided or disclosed will be kept confidential by the owners and will not be made available to third parties.
